Virtual Private Server Terms of Service Addendum
This agreement is between you ("Customer") and The Universes ("The Universes", "we"), for all Virtual Private Server ("VPS") and Hybrid Server and related products and services. Our General Terms of Service also apply (http://www.theuniverses.com/terms/general) to all VPS customers. From here on forward, we will refer to Virtual Private Server and Hybrid Server as simply "VPS".
Acceptable Conduct
You are responsible for the actions of all users of your account and any data that is created, stored, displayed by, or transmitted by your VPS.
You agree to use The Universes services only for purposes that are legal, proper and in accordance with the Terms of Service and the laws of the United States of America.
You agree to not engage in any activity that interferes with or disrupts The Universes' services or networks connected to The Universes.
Prohibited Usage
You agree that any of the below activities are considered prohibited usage and will result in immediate account suspension or cancellation without a refund and the possibility that The Universes will
impose fees; and/or pursue civil remedies without providing advance notice.
Misuse of System Resources: Misuse of system resources, including but not limited to employing programs that consume excessive CPU time, network capacity, disk IO or storage space.
Unsolicited Communications: Sending unsolicited bulk messages utilizing our network. Generating a significantly higher volume of outgoing e-mail than a normal user. Using a non-existent email return
address. Open E-mail relaying.
Access to Other Computers or Networks without Authorization: Attempting unauthorized and/or illegal access of computers, networks and/or accounts not belonging to party seeking access. Any act which
interferes with the services of another user or network. Any act relating to the circumvention of security measures.
Other Activities viewed as Illegal or Harmful: Engaging in illegal activities or engaging in activities harmful to the operations of The Universes or the customer.
Providing False Data on any Contract or Application: including fraudulent use of credit card numbers.
Peer-to-Peer File Sharing and Internet Relay Chat (IRC)
You are not allowed to use Peer-to-Peer file sharing services/programs on your VPS. If we receive a DMCA notice pertaining to file sharing on your
VPS, your account will be terminated without refund. Personal IRC usage is permitted but IRC servers or daemons are not allowed.
Recurring Charges
You agree that your VPS will automatically renew on a monthly, semi-annual, or annual basis unless you cancel by submitting in writting a Ticket in our Orbit Customer Portal
(https://orbit.theuniverses.com/). All cancellations must be submitted 7 days prior to the renewal date.
Account Suspension
The Universes reserves the right to suspend network access to any customer if, in the judgment of the The Universes, the customer's VPS is the source or target of a violation of any of the other
terms of service or for any other reason which The Universes chooses. The Universes will use reasonable care in notifying the Customer and in resolving the problem in a method resulting in the least
amount of service interference. The Universes reserves the right to terminate service without notice for continued and repeated violations of the terms of service. If inappropriate activity is
detected, all accounts of the Customer in question will be deactivated until an investigation is complete. Prior notification to the Customer is not assured. In extreme cases, law enforcement will be
contacted regarding the activity. The customer will not be credited for the time the customer's machines were suspended.
If at any time it becomes necessary for The Universes to cancel a customer's service without cause, The Universes will provide 30 days advance notice.
Unmanaged Services
The Universes provides VPS services that are unmanaged, meaning that the customer is responsible for all software and software related issues and configurations that occur inside their VPS.
The Universes provides support related to your VPS physically functioning only.
Uptime Guarantee
The Universes provides a 99.9% uptime guarantee on VPS hardware and network connectivity. In any given month, if your VPS is down for more than 0.1%, you may request a pro-rated credit for
the down-time. The Universes is not responsible for downtime related to the services listed below and as such will not issues credits for the following:
1. Internal services such as MySQL, Apache, PHP, etc.
2. Scheduled downtime or planned maintenance
3. Interruption of service due to unpaid invoices, abuse notifications and violations of Terms of Service
4. ISP or local connection problems
5. Customer controlled or caused downtime, including Denial of Service attacks on Customer VPS
6. Acts of God
